Website Terms of Use

This English version is a translation provided for convenience only. In the event of any discrepancy between this translation and the Ukrainian version, the Ukrainian version shall prevail.

These Terms govern the use of the website thermera.com.ua (hereinafter the "Website"), operated by Thermera (hereinafter "Thermera", "we"). By using the Website, registering a personal account or submitting a form, you agree to these Terms. The purchase of Goods is governed by the Public Offer, and the processing of personal data by the Privacy Policy.

1. Information on the Website

1.1. We update descriptions, specifications, photos and prices of Goods regularly, but they are provided for reference only. The final price, availability and delivery terms are confirmed by the manager when the order is placed.

1.2. The calculators (seasonal fuel requirement, delivery cost, price per kWh) and the materials of the buyer's guide provide an approximate estimate. Actual fuel consumption depends on the boiler, its settings, the insulation of the building and the weather.

1.3. Photos of the Goods may differ from the actual appearance of a lot due to the natural properties of the fuel and screen settings.

2. Registration and personal account

2.1. The personal account allows you to view your order history, order status and waybill (TTN) number, save delivery addresses, quickly repeat orders and manage subscriptions.

2.2. When registering, you shall provide accurate information and keep it up to date. One person may have one account; a company may have several employee accounts.

2.3. You are responsible for keeping your password secure and for all actions performed from your account. If you suspect that another person has gained access, change your password and notify us.

2.4. You may delete your account at any time in the account settings or by sending a request to [email protected]. After deletion, order data is retained only to the extent required by law (see the Privacy Policy).

2.5. We may temporarily restrict or block an account if it is used in breach of these Terms, for fraud, mass fictitious orders or attacks on the Website. Where possible, we will warn you and explain the reason.

3. Order tracking

3.1. You can view the order status in your personal account or on the tracking page using the order number and the phone number (or e-mail) provided when placing the order.

3.2. Statuses are generated on the basis of data from Thermera and the carrier and may be updated with a delay. Shipment movement data is provided by the carrier, and we are not responsible for its accuracy.

3.3. Do not share your order number together with your phone number, or your tracking link, with third parties: they can be used to view the contents of the order and the delivery address.

4. Notifications

4.1. We send service notifications about your orders (confirmation, status change, waybill number, collection reminder) by phone, SMS, Viber, Telegram or e-mail. They are necessary for fulfilling the order.

4.2. We send promotional e-mails and offers only with your separate consent. You can unsubscribe via the link in every e-mail or in your personal account.

5. Reviews and other user content

5.1. You may leave reviews of the Goods and the service. A review must relate to your genuine purchasing experience.

5.2. It is prohibited to publish: insults, threats, obscene language, advertising of third-party goods and websites, personal data of other persons, false information, or materials that infringe the rights of third parties or the legislation of Ukraine.

5.3. We moderate reviews and may reject or delete those that breach these rules. We do not delete negative reviews that comply with the rules.

5.4. By submitting a review or photo, you grant Thermera a free-of-charge, non-exclusive permission to publish them on the Website and on our social media profiles with your first name (without surname), without time limit. You may request the deletion of your review.

6. Intellectual property

6.1. The texts, buyer's guide articles, photos, graphics, design, software code, logo and the "Thermera" designation belong to Thermera or are used on lawful grounds.

6.2. Quoting materials is permitted provided that an active link to the relevant page of the Website is included. Copying descriptions, photos and articles for other websites or marketplaces without written permission is prohibited.

7. Prohibited actions

• interfering with the operation of the Website, attempting to gain unauthorised access to accounts, the administrative area or other users' data;
• automated collection of Website data (scraping) in a manner that creates excessive load or circumvents technical restrictions;
• sending spam, fictitious requests or malicious code through forms;
• impersonating another person or providing another person's contact details without their owner's consent.

8. Limitation of liability

8.1. We make every effort to keep the Website running without interruption, but we do not guarantee the absence of interruptions, including due to maintenance, power or communication outages, cyberattacks and other circumstances beyond our control.

8.2. We are not liable for losses caused by using the Website's reference calculations without consulting a specialist, or by the actions of third parties who gained access to your account through your negligence.

8.3. The Website may contain links to third-party resources (carriers, messengers, maps). We are not responsible for their content or data processing rules.

8.4. These limitations do not restrict consumer rights established by the legislation of Ukraine.

9. Changes to the Terms and governing law

9.1. We may amend these Terms by publishing a new version on this page. We notify registered users of material changes by e-mail or in their personal account. Continued use of the Website constitutes acceptance of the new version.

9.2. These Terms are governed by the legislation of Ukraine. Disputes shall be resolved through negotiations and, failing agreement, in court.
